Digi - Terms of Service

1. Our Agreement With You

Welcome to Digi, the future of professional connections in Bangladesh. These Terms of Service represent a legally binding agreement between you and Digi. This agreement governs your access to and use of our website, www.digicardbd.com, our smart networking cards, and all related services, features, and content (collectively, the "Service").

Our Privacy Policy is an integral part of this agreement. It details how we handle the information you provide to us. By purchasing a Digi Card, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you may not use our Service. If you have any questions, please contact us at support@digicardbd.com so we can help find a solution.

2. Your Digital Profile & Communications

A core feature of our service is your dynamic digital profile, which is a central hub for your professional identity. When you use our Service, you agree that your profile will be accessible via a public URL. This allows for seamless sharing when you tap your Digi Card. Anyone who receives this URL can view the information you shared.

By creating an account, you also consent to receive communications from us, including service updates, promotional offers, and newsletters. You can opt out of marketing communications at any time by clicking the "unsubscribe" link in our emails or by contacting us directly.

3. Purchasing from Digi

Placing an Order: When you purchase a product or subscription through our Service, you may be required to provide information for the transaction, such as your payment card details, billing address, and shipping information.

Your Warranties: You represent and warrant that (i) you have the legal right to use the payment method you provide, and (ii) all information you supply is true, accurate, and complete.

Payment Processing: To facilitate secure transactions, we utilize third-party payment processors. By submitting your payment information, you grant us the right to provide this information to these third parties, subject to our Privacy Policy.

Order Confirmation & Rejection: We reserve the right to refuse or cancel any order at our discretion. This may occur due to product availability, errors in pricing or product descriptions, suspected fraud, or other violations of these Terms.

4. Subscriptions, Fees, and Billing

Subscriptions: Certain features of our Service are available through a subscription plan ("Subscription"). Subscriptions are billed in advance regularly, typically annually, as specified at the time of purchase ("Billing Cycle").

Automatic Renewal: Your Subscription will automatically renew at the end of each Billing Cycle under the same conditions unless you cancel it through your account settings or by contacting our support team.

Payment Method: A valid payment method is required to process your Subscription. By providing your payment details, you authorize us to charge the applicable Subscription fees to your designated payment method. If automatic billing fails, we may suspend your access to premium features immediately.

Fee Adjustments: We may modify Subscription fees at any time. Any fee change will become effective at the end of your then-current Billing Cycle. We will provide you with reasonable prior notice of any fee changes to allow you to cancel your Subscription before such changes take effect.

5. Our Commitment to Quality: Digi Card Warranty

At Digi, we are proud of the products we create. We stand by their quality and durability.

24-Month Limited Warranty: We warrant that your Digi Card will be free from manufacturing defects and will function according to its specifications for a period of twenty-four (24) months from the date of delivery ("Warranty Period"), under normal use.

What this Warranty Covers:

  • Defects in materials or workmanship.
  • NFC functional failures are not caused by user damage.

What this Warranty Excludes:

  • Normal Wear and Tear: Cosmetic issues like scratches, fading, or dents.
  • User-Inflicted Damage: Damage from bending, exposure to extreme temperatures, accidents, misuse, or unauthorized modifications.
  • Lost or Stolen Cards: We are not responsible for misplaced, lost, or stolen Digi Cards.

Making a Claim: If you believe your Digi Card is defective, please contact us at support@digicardbd.com with your order number and a description of the issue. We may require you to return the card for inspection. At our sole discretion, we will either repair or replace a defective card. This is your sole and exclusive remedy under this warranty.

Lost or Stolen Cards: If your Digi Card is lost or stolen, you must notify us immediately at support@digicardbd.com to deactivate it. Until we receive your notification, you may be responsible for any activity associated with your card. A deactivated card cannot be reactivated.

6. Our Refund & Return Policy

We want you to be satisfied with your purchase.

7-Day Return Window: If you are not satisfied with a non-customized Digi Card, you may request a full refund by returning it within 7 days of purchase.

Non-Refundable Items:

  • Returns initiated more than 7 days after purchase.
  • Customized Products: Cards engraved or printed with personal details (name, logo, etc.) are non-refundable.
  • Products damaged by accident, misuse, or abnormal use.

Process: Once we receive and inspect your returned item, we will notify you via email and process your refund. Please allow up to 10 business days for processing. Refunds may take 1-2 billing cycles to appear on your statement.

7. Content and Intellectual Property

Your Content: You are responsible for all text, images, and other information you post on your public profile ("Content"). By posting Content, you grant Digi a worldwide, non-exclusive, royalty-free license to display and distribute your Content in connection with the Service. You warrant that you own your Content or have the right to grant this license.

Our Property: The Service, its original content (excluding user Content), features, and technology are and will remain the exclusive property of Digi and its licensors. Our trademarks and branding may not be used without our prior written consent.

8. Acceptable Use of the Service

You agree not to use the Service to:

  • Violate any laws or regulations.
  • Infringe on the rights of others, including intellectual property and privacy rights.
  • Transmit spam or unauthorized promotional materials.
  • Impersonate any person or entity.
  • Introduce viruses, malware, or other malicious code.
  • Attempt to gain unauthorized access to our systems or interfere with the proper working of the Service.

9. Termination of Service

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimer of Warranties & Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied. Digi does not warrant that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Digi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total liability to you for any claims arising from the Service is limited to the amount you paid us for the products or services in question.

11. Governing Law

These Terms shall be governed and construed by the laws of Bangladesh, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this site. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
